X-box360 (scratching discs?)

hi.

my son has bought a X-box 360 with HD on top. Anyway, he bought NFS Carbon and began to play the game. He took the game out and there is a perfect circle scratch around 1 centre metre of the disc. the scratch is around the outer edge and is not like a scratch that has been made by oneself as it is a perfect circle right around the disc.

My son has taken the game back to the shop but they say they cannot swap it as the laser has made this scratch. please can you advise. is it possible the laser can do this?

What is my option regarding this if this is possible, has anyone else had this problem.

My friends PS2 did exsactly the same thing, every disc he put in it came out with circular scratches, the laser isn't doing the damage (its impossible), but rather something inside the drive bay is catching it causing the scraches.

Its a fault with the 360, if your local store won't do anything, get M$ on the case.
